What does a work book look like?

Despite the fact that this resolution contains a description of the type of document we are considering today, there is not a hint of how to fill it out correctly (and this information is really very important for drawing up a work book); perhaps some brief rules regarding the process of filling out by a citizen.

The very first document

The procedure for applying for a job is as follows: if a citizen is officially employed for the first time, then the work book is issued to him by the employer himself after a contract (employment contract) is concluded between them. In accordance with this, the organization issues an order, after which, within five days after the conclusion and execution of the contract, a corresponding note is made in the working document form.

Accordingly, if an applicant for a position does not have a work record, this is not a reason to deny him employment and deprive the person of his chances. On the contrary, such actions are illegal, because a citizen previously could simply not work, and he would not be able to obtain a work book in any other way (and there is no need to do so). In this case, when applying for a new job position, a person must personally write an application, which is subsequently addressed to the employer, and directly requests the execution of the form (all this happens in accordance with Article No. 65 of the Labor Code of the Russian Federation). Then the document goes through the process of registration in the accounting database of work books and their movements.

Therefore, to the question of whether they will hire you without a work book, the answer is yes. True, only if the employee suits the organization, then you shouldn’t expect miracles.

Who draws up the work book?

Everything that concerns the organization of storage and reporting on the work books of all employees of any organization, as well as making new entries in them - all this lies on the shoulders of the employer. But all these points are actually carried out by a special employee of the HR department (although sometimes this can be an accountant or manager, this is not so important), who is appointed by a separate order from the organization. This employee has the right to maintain and fill out work books, enter new information and entries into them, as well as sign in them and affix all data with an official seal. All this activity (as well as the order itself on the appointment of the selected employee to this position) may subsequently be subject to inspections by the labor inspectorate.

It is very important to take into account that an employer can only appoint an employee who has such obligations directly in his employment contract or job description to the post of manager of all processes related to work books. If the employer is engaged in personnel records himself, he is obliged by a separate order to take over all these functions.

Required documents

To register a work book, an applicant for a position must provide his employer with a list of documents that are required to register the document, in the same way as the employer contributes to this process. Here is the entire list of required documents:

  1. Education document (certificate, diploma, etc.).
  2. Passport or other official identification document.
  3. Charter of the host company or certificate of individual entrepreneurship.
  4. An accounting journal in which work records are kept.
  5. An official seal confirming the entry into force of the work book.

A work book is a document consisting of a cover and three different parts inside, each of which is responsible for certain information about its owner. Namely:

  1. Title page. It contains information about the owner of the work book (full name, date of birth, passport details, etc.).
  2. Job details. They take into account the entire working experience of the owner of this document, including the name of the organization, the position that the person held there, the duration of the provision of labor services, etc., just like the entry in the work book about temporary employment.
  3. Awards department. All special achievements of the employee are highlighted here, which in the future can bring him numerous bonuses, including when applying for a new job.

Title page design

It is necessary to fill out the title page of such an important legal document as a work book with great care, so this is done by a specially trained employee who is responsible for storing, maintaining and entering the necessary information into the forms. This employee is appointed directly by the head of the organization.

The title page contains data that looks like this:

  1. Full name of the employee.
  2. His date of birth.
  3. Received education.
  4. The profession in which you received your education.
  5. The specialty of this profession.

The first two points are entered into the work book in exactly the same way as in the passport, without any abbreviations. Information about education is taken from the diploma and transferred to the title page with accuracy. A citizen for whom a work document is being drawn up must independently check all the information entered and confirm its validity with a signature, and if he finds an erroneous entry in the work book (about admission or something else) when filling out, the form is destroyed and a new one is created, in which All required information is entered again. Alteration

If the information contained in the title page has changed for some reason, it is crossed out, and a new one is written next to it, after which the documents that are the basis for changing the information are listed on the inside cover (these include a passport and papers, for the issuance of which is the responsibility of the registry office). Registration of information about work

Registration of a work book is a necessary condition for entering a working position, which is based on article number 66 of the Labor Code of the Russian Federation. Even in normal work, personnel department employees of various organizations use forms similar in design to a work book when hiring candidates.

Basic filling rules

To correctly complete the process of filling out the work book with the necessary data, follow the following points:

  1. Entries in the work book are made with fountain pens (fountain pens, gel pens, roller pens - it doesn’t matter) in blue, black or purple. Ink of other colors is not allowed on the document.
  2. The numbers in the work book must be Arabic, and the dates must be in the format dd/mm/yyyy.
  3. The design language is Russian. However, if some individual constituent entities of the Russian Federation additionally have another language at the state level, then in the process of entering all the necessary information into the work book, you can use it.
  4. All words and phrases are entered into the document in full form, that is, without any abbreviations. This applies to positions and various orders - in general, everything that is contained inside the form that interests us.
  5. All data in the work book must comply with orders officially issued by the organization.
  6. To enter all the necessary data, the employee responsible for filling out and maintaining reports on work books has no more than a week from the moment of the immediate event. Exceptions apply to the entry on employment, which, as we remember, is made within five days, as well as the entry on dismissal from a position: it is made on the day the dismissal takes effect.
  7. Any entry in the work book must be accompanied by its serial number. Although in the case of entry numbers in the work book, there are also several exceptions:
  • if the employer himself changes his name, there is no need to put a serial number;
  • if a duplicate of the work book is created, the record of the employee’s length of service also loses the need to attach a serial number to it;
  • Job details section headings are not numbered.

The owner of the work book must be familiar with all the entries in it against signature.

Is it possible to have two work books?

In accordance with labor legislation, any employee must have only one work book, directly from which the employee of the organization responsible for entering data works. However, there are situations in which, for some reason, a person gets a second work book: for example, if an employee, after being fired from a position, lost his work document, and then found it, but only after issuing a new one upon joining the next one. job title.

In this case, the employee does not face any fines or sanctions, because the legislation simply does not provide for such measures. The employer also does not have the right to punish an employee in any way, much less to fine or even refuse to hire if we are talking only about a candidate. It is only important for him to take into account that all necessary work information is entered into only one single work book, since ownership of two at once, again, is not legally prescribed in the law.

In principle, you can simply throw away the extra work document.

Part time job

Some categories of citizens (for example, minors, drivers, medical workers, etc.) have the right to be admitted part-time. The entry in the work book in this case is supplemented after recording the position with the wording “part-time”.

There is also a separate rule for those who enter into an agreement with an employer while being an apprentice (student, intern). In the same way, all this is noted in the document. “Accepted as a student” - the entry in the work book in this case looks exactly like this.

Preparation of documents for further employment

But working in different organizations with two different work books is illegal and strictly punishable by the court. Therefore, remember that an application to the employer with a request to issue a new form should only be made if you have actually lost your work book and you simply do not have it.

Samples for filling in cases of hiring and dismissal

As already mentioned in this article, when an employee takes up a new position, the employer, no later than five days later, records information about this action, carried out on the basis of an official order, directly into the work book itself. If a citizen is employed for the first time, then he puts his signature on the title page of his new employment document, thereby confirming the absence of any errors in filling out the data (although he is not responsible for this notorious correct filling).

Do not forget that if the employer is an individual who is not registered as an individual entrepreneur, then he is deprived of the right at the legislative level to acquire new work books (and all this is carried out exclusively in accordance with the laws on official registration of work). In this case, all data on the employee’s length of service and work activities will be notarized by a written agreement, which is concluded specifically in such cases.

On the day when an employee leaves work (that is, finishes the last day of work, also provided for by law and for ignoring which there is a serious fine), the employer is obliged to give him all documents related to the position, including a work book. Afterwards, the employer pays the employee, gives him his last salary, and then their paths diverge.

There are cases in which an employer, for some reason, cannot issue a work book to an employee. Then they draw up a written protocol, from which the employee learns about the need to pick up the document and agrees to have it sent to him by mail. From the moment the employer sent this message to this person, he does not bear any responsibility for possible delays in the receipt of his former employee’s work book. He also avoids this responsibility when the actual last day of the worker is different from the day indicated in the expiration date of the employment contract drawn up upon taking office.

There are many similar situations, and they are all varied, so the employee of the organization, who is the main one in matters of personnel affairs and maintaining work records, needs to study all possible grounds for legal actions related to employment, as well as the wording that will need to be entered in each individual case.

An entry in the work book about hiring is understandable, but when an entry about dismissal is made, it is very important to take into account that its grounds and reason must in one way or another correspond to what is prescribed in this regard in the legislation of the Russian Federation. Nuances and interesting facts

Owners of old-style work books do not have to replace them with new ones, and the federal body responsible for services related to labor and employment of citizens (called Rostrud), back in April 2017, approved the abolition of work books, which had been discussed for many years.

This is due to the desire of the authorities to increase the protection of the rights of working citizens, as well as to significantly simplify or even prevent many bureaucratic processes associated with maintaining, storing and forwarding work books. In what case can an employee work without being recorded in the work book?

The instructions require making a record of the employee's employment with the main employer if he has worked for the company for five or more days. When the period of work in the company is less than the established period, you do not need to make any employment records.

Notes on employment are not made in the labor office if the employee is hired part-time. Such entries are included in this form only if the employee submits a corresponding application.

Let's return to a further review of the records. After filling out the title page, you must indicate the employee’s education. This information is entered in the following order:

  1. basic general;
  2. average general;
  3. initial professional;
  4. secondary vocational;
  5. higher professional;
  6. postgraduate professional.

These entries cannot be made if you do not have certificates, certificates, diplomas, etc., that is, duly certified documents indicating a particular level of education. That is, entries in the work book must always have documentary evidence.

If there is incomplete education (naturally, at the appropriate level), then an entry can only be made if certified evidence is presented. These will be:

  • student ID;
  • record book;
  • educational institution.

Please note that these documents must be provided in a package, that is, all together. One of them is not a basis for recording. The work book must have the date it was completed. The employee puts his signature on the first sheet. A different signature on the title page will belong to the person who issues work books and is responsible for this. The specifics of filling out a work report are such that sooner or later you will have to make entries in it that will be in relation to previous changes. Practice shows that changes most often concern such records as:

In order to make new entries that invalidate old ones, it is necessary to have a basis. In other words, documentary evidence of changes in information. Thus, when entering new data into the work book regarding changes in full name and/or date of birth, you must have a basis, which is:

Let us note some changes in the procedure for filling out work books. Now the joint-stock companies have the right to decide independently the issue of the need for a round seal. This resolution came into force on April 7, 2015. Rostrud, however, introduced clarifications on this issue.

There is still an obligation to affix a stamp to the work book. That is, if one of the mentioned organizations refused to use the seal, then the work book will still have to be certified when recording.

For this purpose, a personnel seal or any other one related to the organization is sufficient. Let us note an important detail. When filling out the work book for the first time, the lack of work experience is not recorded. If the first entry for employment is made immediately after the employee graduates from a special educational institution, then the time of training is also not recorded in a separate entry.

Let us again pay attention to errors that occur quite often. Column 2 often incorrectly records the date when the employee was hired. Sometimes they set the date for drawing up the order. This is incorrect, because it is necessary to set a date that relates to the employee, and not to the decree, and is included in the text of the decree. That is, these dates should not be confused.

Column 3 is designed to record which structural unit the employee is assigned to. Its name is indicated. Also regarding the employee, his position, specialty, profession, and qualifications are included. Column 4 is information about the order. The number and date of the document compiled are entered here.

It should be borne in mind that hiring can be carried out not only by drawing up an order, but also on the basis of other documents.
